Washington – The Department of Labor is proposing to delay until May 20 the effective date of a final rule intended to protect workers from beryllium.
OSHA previously delayed the effective date to March 21 from March 10. The delays are in response to a Jan. 20 White House memorandum that instructed DOL to review new or pending regulations and postpone their effective dates.
DOL stated in a March 1 press release that “it is appropriate to further delay the effective date to May 20, 2017, for the purpose of additional review into questions of law and policy.”
The proposed delay will not change the rule’s compliance dates, according to DOL – employers will have one year to comply with most of the rule’s provisions.
Comments on the extension are due March 13. At press time, the proposed delay was scheduled to be published in the March 2 Federal Register.
